MightySlide END USER LICENSE AGREEMENT

This is a legally binding contract between you, referred to as “YOU,” and MightySlide. This License Agreement applies without limitation to the website currently located at MightySlide.com and any other version of the foregoing, as well as any content delivered via any storage media. MightySlide.com is the name of this presentation, and all documents and materials contained within it are referred to as the “PowerPoint presentation Template” or the “CONTENT” in this document.

Receiving access to, downloading, and/or using all or most (any portion) of MightySlide’s PowerPoint presentation confirms your acceptance of these terms and forms a legal contract between you and MightySlide.

MightySlide reserves the right to modify the terms of this agreement at any time, and you agree to be bound by such modifications.

Acceptance of all the terms and conditions of this End-User License Agreement is equivalent to a written agreement signed by you by accessing, registering, or using all or any portion of the PowerPoint presentation Template or CONTENT. This Agreement applies to you and any legal entity that obtained the PowerPoint presentation Template and used it on your behalf.

MightySlide permits to download, installation, use, or otherwise benefit from the functionality or intellectual property of the PowerPoint presentation template only in accordance with the terms of this. 

PROPRIETARY RIGHTS.

All title, ownership, and intellectual property rights in the PowerPoint presentation template and CONTENT, including but not limited to all supporting paperwork, files, marketing material, photographs, and multimedia, remain with MightySlide and its suppliers. Copyright and other intellectual property laws, as well as international treaties, protect the PowerPoint presentation template and CONTENT. Security controls may be included in the PowerPoint presentation template and CONTENT to limit access and prevent unauthorized copying and use. You promise not to tamper with any of these security features. The use of third-party material included in the PowerPoint presentation template or the CONTENT may be governed by the terms and restrictions set forth in the party’s own license agreement.

LIMITED LICENSE:

MightySlide’s presentation is licensed, not sold. MightySlide grants you a limited license to use MightySlide’s presentation for your personal or business purposes only. You may not resell, rent, lease, lend, sublicense or transfer the presentation in whole or in part to any other person or entity. You can modify the content of MightySlide’s PowerPoint template in any way. You may not use MightySlide’s PowerPoint template for any illegal purpose.

TERMINATION OF LICENSE AND ACCESS TO MIGHTYSLIDE'S POWERPOINT TEMPLATE

Your license terminates automatically and without notice if you breach any term of this agreement or if you fail to comply with any applicable laws and regulations. Upon termination of your license, you must immediately destroy all copies of the Mightyslides PowerPoint template that are in your possession or control. 

Customers ALLOWED USAGE

  • Create derivative works or modifications from the CONTENT in editable format, provided that such creations are not meant to be resold or distributed publicly for free.
  • Professional, business, personal, and educational presentations that can be viewed by a public audience, within a learning or e-learning platform, internal network, or any other content delivery platform that can be sold or licensed to the audience, provided that copyright credit is given to MightySlide for the creation of the CONTENT used, if and only if the redistribution or sale is not for the purpose of gaining access to the CONTENT specifically.
  • Banners (physical print), Posters (physical print), and any other reproductions listed in (b.) above, but not for sale, licensing, or other distribution.
  • Advertising, brochures, promotional collateral, and promotional initiatives, such as printed materials, packaging, presentations, video presentations, commercials, promotional cards, and postcards, are not for sale or licensing.
  • Create derivative works or modifications from the CONTENT in editable format, provided that such creations are not meant to be resold or distributed publicly for free.
  • As a customer of our templates, you obtain unrestricted access to edit, replicate, print, backup, copy, customize and use our products.
  • You can use our templates for one or more presentations (personal or commercial presentations). You can use our templates for commercial presentations, as long as you are the owner of the presentation.
  • We do not provide any warranty and we are not responsible for any damage resulting from the use of our templates.
  • By purchasing these templates, you accept all terms and conditions.
  • You can customize our templates to match your own company’s visual identity.
  • As a customer of our templates, you obtain unrestricted access to edit, replicate, print, backup, copy, customize and use our products.
  • You can use our templates for one or more presentations (personal or commercial presentations). You can use our templates for commercial presentations, as long as you are the owner of the presentation.
  • You can customize our templates to match your own company’s visual identity.
  • As a customer of our templates, you obtain unrestricted access to edit, replicate, print, backup, copy, customize and use our products.

Customers NOT ALLOWED USAGE:

You may NOT sell, resell, publish or distribute the templates in any way. You may not redistribute, share, sell or give away the templates in any way. The templates can be used for commercial presentations. You may not use any of our templates in pornographic, racist or illegal material.

  • Unless otherwise specified in Section ALLOWED USAGE, do not copy or replicate the CONTENT.
  • The CONTENT or rights to the CONTENT may not be sold, distributed, sublicensed, transferred, or assigned.
  • You cannot modify or create new documents based on our templates, even if you do it only partially.
  • You cannot give or sell our templates to other people.
  • You cannot use our templates for any pornographic, racist or otherwise illegal purposes.
  • You may not remove or change any part of the template files, including (but not limited to) images and text
  • Customers cannot resell or distribute our templates in any 3rd party website or business, offline or online.
  • Our products are NOT distributable. Even if you have a membership subscription or purchased templates from our site, you cannot provide them for free or resell the products (unedited or modified version) in any other website or media device without prior authorization.
  • Our products are protected by copyright and trademark laws. You cannot copy or distribute our templates in any media. You cannot resell or distribute our templates in any 3rd party website or business, offline or online.
  • You may not remove or change any part of the template files, including (but not limited to) images and text.
  • You may not sell our products under your own brand name without prior authorization from us.

CONFIDENTIALITY

All information provided to you by us is confidential and proprietary to us. This includes, but is not limited to, any information relating to our business, products (including this website), technology, customers, or finances. You agree not to use any such information in any way whatsoever except as necessary for the purpose of this Agreement.

You shall not disclose or make available such confidential information in any form to any third party without our prior written consent.

COPYRIGHT

All content on this site is copyrighted material and owned by us or our licensors. The compilation consisting of the content found on this site is the exclusive property of us and our licensors. Content on this site may be downloaded for personal use only; however, you may not modify or re-use it in any way or reproduce it for distribution or other use without our prior written consent.

You may download one copy of the materials (information or PowerPoint presentation Template) on this site for personal, non-commercial home use

NON-TRANSFER OF RIGHTS

You may not sell, rent, lease, distribute or otherwise transfer any of the materials on this site to any third party without our prior written consent. You may not frame or utilize framing techniques to enclose any of the materials on this site without our prior written consent. You may not use such materials on any other Web site without our prior written consent.

PUBLICITY

Without MightySlide’s prior written authorization, you may not mention this EULA in any press release, website, advertising, or other publicly disseminated or accessible content.

LIMITATION OF LIABILITY

Except is required by law, so MightySlide will not be responsible for any direct, indirect, special, incidental, consequential or ordinary damages resulting from the use of this PowerPoint presentation Template or its content. Even if we are warned about the possibility of damage, MightySlide liability is limited to satisfaction of the restorative amount.

DISCLAIMER OF WARRANTY

You agree to accept the PowerPoint presentation and its contents “as is” and with all flaws (if any). MightySlide expressly disclaims any explicit or implied warranties, including, but not limited to, warranties of merchantability and fitness for a particular purpose. MightySlide offers no warranties or claims about the content and your use of it, or about the content’s suitability to meet your specific needs. The material is thorough, but the format is generic. There may be rules in your state/province/country that require consideration in any final material.

VIOLATIONS OF THIS EULA.

MightySlide reserves all rights not expressly given to you in the above paragraph. MightySlide reserves the right to take legal action against you if you violate MightySlide’s rights. Any use that does not fall within the specific extent of the license granted herein will be considered an infringement. You understand and agree that MightySlide’s damages will be severe in the event of your violation of this EULA and that MightySlide will suffer irreparable harm in such an event. As a result, MightySlide shall be entitled to equitable remedies, including but not limited to monetary damages, injunctions, statutory damages, attorney fees, and any other available legal remedy.

TERMINATION

  • Should you fail to perform any obligation required by this EULA, engage in activity that MightySlide deems harmful to its well-being, or become bankrupt or insolvent, MightySlide shall have the sole and exclusive right to immediately terminate this EULA and suspend your license to use the PowerPoint presentation Template and CONTENT. This EULA becomes effective upon installation of the PowerPoint presentation template and CONTENT and will continue in effect until canceled. Should MightySlide terminate this EULA, you must return the original and any copies of the PowerPoint presentation template and CONTENT, including partial copies and modifications, to MightySlide.
  • YOU may terminate this EULA by destroying the downloaded CONTENT, any digital storage or related materials, and discontinuing any usage of the CONTENT and PowerPoint presentation template for any reason.
  • To keep this EULA in force, you must have an active MightySlide If your account expires, YOU MAY CONTINUE TO USE THE CONTENT UNDER THIS EULA. If your account expires, you will no longer be able to access the PowerPoint presentation template or extra CONTENT. 

WAIVER & SEVERABILITY.

The waiver of any breach of this EULA by MightySlide does not represent an amendment to this EULA or MightySlide waiver of subsequent breaches. If any part of this EULA is deemed to be void and unenforceable, the remainder of the EULA will remain valid and enforceable in accordance with its terms.

ELECTRONIC NOTICES.

You agree that MightySlide may send you information and notices about the PowerPoint presentation template, CONTENT, and MightySlide to the email address you give when you register your account or afterward. MightySlide may send you notices by email if you have given MightySlide a valid email address, or (ii) publishing the notice on the MightySlide website or the CONTENT download site that MightySlide owns and operates. You may withdraw your consent for electronic notices.

AMENDMENTS.

MightySlide maintains the right to unilaterally modify all offers, price conditions, and other items relating to the PowerPoint presentation template and CONTENT, MightySlide website, or this EULA. No course of dealing or commercial usage shall be deemed to modify the conditions of this EULA.

COMPLETE AGREEMENT.

This is the full EULA between MightySlide and you about the PowerPoint presentation template and CONTENT, and it supersedes any previous representations, conversations, undertakings, warranties, communications, or advertising relating to the template.
